By accessing or using our services, you agree to comply with and be bound by the following terms. If you do not agree with these terms, please refrain from using our services.
1. Definition of Services
The Services provided by the Company include elderly care services such as wellness support, medical assistance, daily living support, and companionship. The scope of these services is subject to customer needs and preferences and may be modified at the Company’s discretion. The Company shall not be responsible for any medical emergencies unless specifically included in the service agreement.

2. Service Timings
In case of any changes to service timings, the Company will notify customers via email, phone, or updates on the official website or application. Services are available during specific hours as stated on our official communication channels or directly communicated by the Company. General office timing: 9 am to 7 pm. Extended support available based on customer requirements and availability of service professionals. Service availability timing may vary during public or local holidays or celebrations. The Company reserves the right to alter service timings without prior notice.
3.Changes to Services
The Company may, at its sole discretion, modify, suspend, or discontinue any Service, temporarily or permanently, without notice. The Company will not be liable if Services are unavailable due to circumstances beyond its control, including but not limited to natural disasters, technical issues, or regulatory changes.
4.Eligibility
Services are intended exclusively for individuals aged 56 years and above. Valid identification, such as a Driving License, Aadhar Card, or Passport, must be provided to verify age. Failure to provide accurate and valid proof of age may result in disqualification from receiving Services. However, company may choose to go for exception based on urgency and humanitarian ground.
5.Payment Terms, Refund Policy, and Cancellations
The Company accepts payments through online transfers, credit/debit cards, or other authorized methods. Refunds will be processed only in the event of cancellation made within 7 days of booking for annual and monthly plans and 24 hours for weekly plans, subject to deductions for any services already rendered or administrative costs. Deposits, if applicable, are non-refundable.
All payments for Services are due as specified in the relevant invoice or agreement. The Company reserves the right to terminate Services for non-payment. Refunds and cancellations are subject to the Company's policy, which may be amended from time to time. Customers must notify the Company of any cancellations within 6 hours before the scheduled time.
6.Customer Conduct and Responsibilities
If a customer provides false information or fails to comply with company guidelines, the Company reserves the right to terminate services without refund and may pursue legal action for damages caused.
Customers are expected to maintain respectful and appropriate conduct while using the Services. The Company reserves the right to refuse or discontinue Services to any Customer exhibiting inappropriate, abusive, or violent behavior. Customers are responsible for ensuring that they provide accurate information and comply with all applicable laws while using our Services.
7.No Guarantee or Warranty
The Company is not liable for the actions or omissions of third-party service providers engaged during the course of providing services.
The Company provides Services "as is" without any guarantees or warranties, express or implied. The Company does not guarantee that the Services will meet the Customer’s expectations or be uninterrupted or error-free. The Company and its affiliates shall not be liable for any indirect, punitive, or consequential damages arising from the use of Services.
8.Limitation of Liability
The Company is not responsible for harm resulting from accidents, self-inflicted injuries, or medical conditions arising during the service provision. Liability does not extend to any third-party services contracted for special tasks or emergencies unless explicitly stated.
The Company, its directors, officers, employees, agents, and affiliates will not be liable for any direct or indirect losses, damages, injuries, or fatalities resulting from the use of the Services. Customers agree to indemnify and hold the Company harmless from any claims, liabilities, costs, or expenses arising from their use of the Services, violation of these Terms, or infringement of any rights of third parties.
9.Force Majeure
The Company shall not be liable for any failure or delay in the performance of its obligations due to events beyond its reasonable control, including but not limited to acts of God, war, strikes, natural disasters, pandemics, or governmental restrictions ("Force Majeure Events").
10.Intellectual Property Rights
All intellectual property rights, including but not limited to trademarks, logos, and content used by the Company, remain the property of the Company. Unauthorized use, reproduction, or distribution of any Company materials is prohibited.
11.Indemnification
Customers agree that family members or legal representatives will not hold the Company liable for any dissatisfaction or injury during the services. The customer indemnifies the Company from any claims filed by third parties due to the customer’s failure to comply with these Terms.
Customers agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from any claims, losses, damages, or expenses, including legal fees, arising from
(i) the Customer’s breach of these Terms,
(ii) any violation of applicable laws,
(iii) fines, penalties, or sanctions imposed by authorities,
(iv) harm to employees,
(v) damage to property.
12. Data Protection and Privacy
The Company shall ensure that customer data is secured through encryption and will only be retained for the duration necessary for service provision or as required by law. Customers may request deletion of their data, subject to the Company’s data retention policy and legal requirements.
The Company collects and processes personal data in accordance with its Privacy Policy. Personal information will be used solely for service delivery, marketing, research, and as required by law. By using our Services, you consent to the collection, use, and disclosure of your personal information as outlined in our Privacy Policy.
13.Confidentiality and Non-Disclosure
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the term of service. Neither party shall disclose such information to any third party without prior written consent, except as required by law.
14.Termination
Conduct deemed harmful includes, but is not limited to, abusive behavior towards staff, failure to provide accurate information, or refusal to comply with safety guidelines.
The Company reserves the right to terminate the provision of Services immediately for breach of these Terms, non-payment, or conduct deemed harmful to the Company, its employees, or other customers. Notice of termination will be provided in writing.
15.Amendments to Terms
The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Customers are responsible for reviewing the Terms regularly to stay informed of any updates.
16.Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of India.
17.Dispute Resolution
The venue for arbitration shall be Kolkata, West Bengal, India, and the language of arbitration shall be English.
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the matter through mediation. If mediation fails, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. 18.Release of Liability
The Customer agrees to release the Company and its employees from any liabilities, including injuries, damages, or losses incurred during service provision. This release extends to any claims arising from unforeseen incidents or accidents.
19. Acceptance of Terms
By using the Company’s Services, the Customer acknowledges having read, understood, and agreed to these Terms. The Customer affirms that they are availing of the Services voluntarily and assume all associated risks.
